Interesting Court of Cassation :

In a recent Dubai Court Judgment, the Court ruled in the appeal filed by the Attorney General that, in the event of a claim from the land developer against the purchaser, the role of the Land Department is merely conciliatory to propose suitable solutions for the parties in order to reach an amicable settlement.
Unless the parties mutually agree to terminate the sale agreement, only courts can issue final decisions to terminate agreements between real estate developers and purchasers.

Facts of the case

The First Respondent in this case, a real estate investment company, initiated legal action before the Dubai Court of First Instance seeking a court order against a Real Esate Agent (the “Third Respondent”) to refund the sum paid to the latter as installments of the purchase price for two real estate units located in the Water Front living project. The legal action was filed on the ground that the Third Respondent failed to register the unit as required by the law.

The Third Respondent pleaded that in this transaction, it was acting as an agent for the Second Respondent and requested the action to be dismissed for having been brought against a party who has no capacity within the substantive matter of the dispute and therefore sought to join the Second Respondent to the case.

Procedural History

The First Respondent (Claimant) filed its amended statement of claim to include the name of the Second Respondent. The Land Department confirmed that the units (the subject of the dispute) are registered in the Interim Real Estate Register. In light of this, the First Respondent sought to annul the Sale agreement or alternatively to cancel/terminate the agreement as the Second Respondent failed to commence any construction on the units to date, nor did it secure the required building permits which the First Respondent sought to establish by way of first hand inspection by a court appointed expert.

The Court of First Instance rendered its ruling by dismissing the case. As a consequence, the First Respondent appealed before the Court of Appeal which overturned the lower court’s decision and further rejected the case as a result of the administrative decision (issued in the same case) by the Dubai Land Department.

The First Respondent challenged the Court of Appeal’s decision before the Dubai Court of Cassation which dismissed the case on the ground that the action is time barred.

The Attorney General challenged the same Court of Appeal ruling pursuant to Article 174 of the UAE Civil Procedure Law which entitled the Attorney General to challenge final decisions of any court provided that the court’s judgment contradicts the law or its application.

The Court of Cassation

The Attorney General argued that the appealed judgment was wrong to consider the administrative decision (rendered by the Land Department) as a conclusive and binding judicial ruling which had the effect of res judicata, in other words, the lower court rendered the Land Department’s decision as equivalent to a Court judgment, which was incorrect. The Attorney General further pleaded that the appealed decision contradicted both Article 11 of the Interim Real Estate Register Law No. 13 of 2008 and Article 15 of the Executive Council Decision no. 6.

The Cassation Court, in its ruling, stated that articles from the UAE Civil Transactions Law as well as the aforementioned articles the Interim Real Estate Register Law No. 13 of 2008 and the Executive Council Decision No. 6 of 2010 provide that contracts may be terminated either by parties’ agreement or a court order. Furthermore, the role of the Land Department in settling a developer-purchaser dispute is to endeavor and conciliate suitable solutions for the parties in order to reach an amicable settlement and does not extend to the termination of contracts. The court further stated that the Land Department’s decision is not conclusive so as to preclude bringing an action for breach of contract to determine entitlement to recover damages under the law.

The lower court failed to examine the merits of the dispute when it decided to dismiss the action on the basis that the Land Department had previously issued a decision authorizing termination of the units sale agreement, and that this administrative body, which was not a party to the proceedings, had exercised its powers and rights in accordance with the law. Therefore, the Cassation Court overturned the appeal judgment and referred the case back to the Court of Appeal.

Practice note:

The above Cassation decision confirms that the Land Department’s role in disputes is limited to conciliation and is subject to judicial review, it further highlighted that there is judicial control over administrative decisions and that it is the Courts that ultimately terminate real estate agreements.

Drugs that are legal in your home country may not necessarily be legal in the UAE, this could include drugs that you have been prescribed for medical reasons in your home country. 2) The import of illegal drugs in to the UAE is a criminal offence.. This includes whilst transiting through Dubai airport. If you have obtained a prescription for medication from your home country, it is recommended to carry a translated and attested copy of the prescription with you.3) Take particular care when returning from holiday if you may have come in to contact with anyone who has taken an illegal drug and may have passed even the smallest quantity on to you. Possession of illegal drugs, even for example a speck on a shoe, may be a criminal offence.4) Some medications are illegal in the UAE if possessed without a prescription from a Doctor. These include some sleeping pills, antidepressants and pain killers. Check with your Doctor whether a prescription is required before taking these types of medicines.5) Do not keep silent when you witness a drug crime, as you are legally under the obligation to inform the concerned authorities (police hotline). 6 ) Convince a drug consumer to surrender himself to the concerned authorities prior to being caught, as the applicable law considers the same and takes it into consideration.

في شأن الإبعاد عن الدولة

تنص المادة 121 من قانون العقوبات الاماراتي الاتحادي رقم (3) لسنة 1987م على أنه
" إذا حكم على أجنبي بعقوبة مقيدة للحرية في جناية أو جنحة جاز للمحكمة أن تأمر في حكمها بإبعاده عن الدولة ويجب الأمر بالإبعاد في الجنايات الواقعة على العرض . 
ويجوز للمحكمة في مواد الجنح الحكم بالإبعاد بدلاً من الحكم عليه بالعقوبة المقيدة للحرية المقررة للجنحة ."

وحيث قد أستقر قضاء المحكمة الاتحادية على أن الأمر بالإبعاد وعلى ما ورد بالمادة 121 وما بعدها من قانون العقوبات الاتحادي ، جوازي للمحكمة لها أن تقضي به على الأجنبي الذي يرتكب جناية أو جنحة ولا تلتزم المحكمة به وجوبياً إلا في الجنايات الواقعة على العرض حيث يفترض فيها خطورة الجاني على المجتمع ...مما مفاده أنه يتعين الأمر بإبعاد الأجنبي عن الدولة إذا قضي بإدانته بارتكاب جناية من الجنايات الواقعة على العرض ، وفي غير ذلك يجوز للمحكمة أن تقضي بإبعاد الأجنبي إذا حكم عليه بعقوبة مقيدة للحرية في جناية أو جنحة إذا رأت أن المصلحة العامة تقتضي ذلك ، مما مقتضاه أن الأمر بإبعاد الأجنبي في حال الحكم عليه بعقوبة مقيدة للحرية في غير الجنايات الواقعة على العرض من إطلاقات محكمة الموضوع تقدره حسبما تراه من ظروف الواقعة وخطورة المجرم دون رقابة من محكمة النقض عليها في ذلك ...

لما كان ذلك وكان من المقرر قانوناً أن الخطأ غير العمدي هو إخلال المتهم عند تصرفه بواجبات الحيطة والحذر التي يفرضها القانون ، وعدم حيلولته تبعاً لذلك دون أن يفضي تصرفه الى حدوث النتيجة الإجرامية في حين كان في إستطاعته ومن واجبه ذلك ، وعلى ذلك فإن جوهر الخطأ غير العمدي هو إخلال بإلتزام عام يفرضه المشرع ، وهو الإلتزام بمراعاة الحيطة والحذر والحرص على الحقوق والمصالح التي يحميها القانون ...
ولما كان المعيار الذي يتحدد وفقاً له ما إذا كان ثمة إخلال بواجبات الحيطة والحذر ، هو معيار موضوعي قوامه الشخص المعتاد ، أي الشخص الذي يلتزم في تصرفاته قدراً متوسطاً من الحيطة والحذر ، فإذا إلتزم المتهم في تصرفه القدر من الحيطة والحذر الذي يلتزمه هذا الشخص فلا محل لإخلال ينسب إليه ، أما إذا نزل دون ذلك ، نُسب إليه الإخلال ولو إلتزم ما إعتاده من تصرفاته ، إذ أن القانون لا يقره على ما إعتاد عليه من تصرفات ...

ولما كان من المقرر أن الخطأ ينتفي بإنتفاء أحد عناصره ، فإذا ثبت أن المتهم لم يخل بواجبات الحيطة والحذر التي يفرضها القانون وأن الشخص المعتاد لو كان في مثل ظروفه لتصرف على ذات النحو الذي تصرف به ، فلا وجه لنسبة الخطأ إليه ...

ولما كان من المقرر قانوناً أنه إذا كان خطأ المجني عليه من الغرابة والشذوذ والجسامة على نحو لا يستطيع معه المتهم توقعه ، مما يجعل النتيجة التي ترتبت عليه غير متوقعة بدورها ، فإن أحد عناصر الخطأ ينتفي بذلك ، وهو إستطاعة المتهم توقع النتيجة الإجرامية ، ووجوب ذلك
عليه . ويمكن في هذه الحالات القول بأن خطأ المجني عليه قد إستغرق خطأ المتهم ، وكان كافياً بذاته لإحداث النتيجة ...

وعلى ذلك إذا كان خطأ المجني عليه ـ بالنظر الى الظروف التي صدر فيها ـ غير متوقع بحيث لم يكن في إستطاعة المتهم ومن واجبه توقعه فهو ينفي خطأه ، وتبعاً لذلك ينفي مسؤوليته عن النتيجة ، وتنحصر المسؤولية فيمن ظلت عناصر الخطأ متوافرة في حقه ...

ولما كان من المقرر كذلك أن المسؤولية تنتفي إذا كانت ثمة قوة قاهرة أو حادث فجائي هو الذي أدى الى حدوث النتيجة ، وتعني القوة القاهرة محو إرادة المتهم بحيث لا ينسب إليه سوى حركة عضوية مجردة من الصفة الإرادية .

الحالة الاولى وهي جزائية ويكون الحق هنا كامل للنيابة العامة في إصدار الأمر بالمنع من السفر على أحد الأشخاص لوجود بلاغ أي إتهام جزائي. وقد يكون الحق في التعميم بالمنع من السفر لجهة الشرطة في حالات أخرى حددها القانون.

على سبيل المثال في حالة جريمة اصدار شيك من دون رصيد ( بسوء نية ) 

الحالة الثانية وتكون في المعاملات المدنية إذا كان هناك دين لأحد الأشخاص أو الجهات بالدولة معين المقدار وحال الأداء يجوز لصاحب الشأن أن يتقدم للقاضي المختص بطلب المنع السفر.

البراءة هي الاصل والشك يجب ان يفسر دائماً لمصلحة المتهم .

إذا كان الأصل في الإنسان البراءة ، فإنه يجب لإدانته أن يقوم الدليل القاطع
يقينياً بإرتكابها وبنسبتها إلى المتهم ، فإذا ثار شك لدى القاضي في صحة أدلة الإثبات وجب عليه أن يقضي بالبراءة, أي أن الشك يجب أن يفسر لمصلحة المتهم

إن الأحكام يجب أن تبنى على الأدلة التى يقتنع منها القاضى بإدانة المتهم أو ببراءته صادراً فى ذلك عن عقيدة يحصلها هو مما يجريه من التحقيق مستقلاً فى تحصيل هذه العقدية بنفسه لا يشاركه فيها غيره و لا يصح فى 

القانون أن يدخل فى تكوين عقيدته بصحة الواقعة التى أقام قضاءه عليها أو بعدم صحتها حكماً لسواه .

الاستيقاف هو إجراء بمقتضاه يحق لرجل السلطة العامة أن يوقف الشخص ليسأله عن هويته عن حرفته ومحل إقامته ووجهته إذا اقتضى الحال على أساس أن له مسوغ

جريمة انتحال الصفة

لما كانت جريمة انتحال الوظائف العمومية والصفات المنصوص عليها بالمادة 250 من قانون العقوبات تقوم على أربعة أركان :
الركن الأول وهو الركن المادي والذي يتمثل في انتحال وظيفة من الوظائف العامة أو التدخل في وظيفة أو خدمة عامة أو إجراء عمل من أعمالها أو من مقتضياتها .

والركن الثاني وهو الانتحال أو التدخل في وظيفة أو خدمة عامة .

والركن الثالث وهو التدخل في الوظيفة أو الخدمة العامة أو إجراء عمل من أعمالها بدون حق ، والركن الرابع وهو القصد الجنائي ...

ولما كان المستفاد من نص المادة 250 أن مجرد انتحال صفة الموظف لا يعتبر بذاته تدخلاً في الوظيفة لما يقتضيه هذا التدخل من أعمال إيجابية تكون ــ بالإضافة إلى ادعاء الصفة وانتحالها ــ الافتئات الذي قصد الشارع أن يكون محلاً للعقاب ، وبناء على ذلك فإن توقيع العقوبة الواردة بنص هذه المادة على من لم يقع منه أكثر من ادعائه كذباً بأنه مخبر ، يكون خطأ إذ هذا العمل لاعقاب عليه قانوناً ...

وبطبيعة الحال فإن مهنة المحاماة تتطلب التعامل مع مصالح متعارضة فلا يجب أن يؤثر ذلك في علاقة المحامين بعضهم ببعض، وعلى صاحب هذه المهنة احترام زملائه عند الترافع وعدم التهجم عليهم والاساءة لهم، وعدم تشويه سمعة زميل له، لاسيما إذا كان خصمه في الدعوى، وعدم التعامل مع ملف القضية بخصوصية منفردة، وبناء على ذلك، فعلى المحامي أن يبذل العناية والجهد اللازمين للدفاع عن القضية بما يمليه عليه شرف المهنة.

وفي ما يتعلق بعلاقة المحامي بالقضاء، فهذه العلاقة يجب أن تكون مبنية على الاحترام المتبادل الذي يليق بكرامة وهيبة القضاء والمحامي، على حد سواء، فهم القضاء الجالس والمحامي القضاء الواقف.

وهذه المهنة، لها آدابها الخاصة وتعرف في القضاء بـ«آداب المحاماة» تتمحور فيها عرفاً وتقليداً وأدباً، وعلى مر العصور حولت تلك الآداب إلى واجب يتعين على المحامي التقيد بها والعمل على التخلق بها.

لذلك كانت مهنة المحاماة جليلة القدر لجلال رسالتها وعظم شرفها، وكان على من يزاولها أن يكون جديراً بحمل لقب «المحامي»، نبيلاً بتصرفه، سليماً في سلوكه، حسناً في مظهره، يضفي على من يراه مظهر الاحترام والوقار.

البلاغ الكاذب حسب قانون العقوبات الاماراتي واجتهادات محاكم التمييز أن الركن الأساسي في جريمة البلاغ الكاذب هو تعمد الكذب في التبليغ مما مقتضاه أن يكون المبلغ عالماً يقيناً لا يداخله شك في أن الواقعة التي أبلغ بها كاذبة وأن المبلغ ضده بريء منها ، وانه يلزم لصحة الحكم كذب البلاغ أن يثبت للمحكمة بطريق الجزم توافر العلم اليقيني وان تستظهر ذلك في حكمها بدليل ينتجه عقلا ، انه يشترط لتوافر القصد في تلك الجريمة أن يكون الجاني قد أقدم على تقديم البلاغ منتوياً السوء والإضرار بمن أبلغ في حقه مما يعني الحكم القاضي بالإدانة في هذه الجريمة ببيان هذه القصد بعنصرية ، كما لا يصح القول بأنه إذا عجز المبلغ عن الإثبات فان بلاغه يعتبر كاذباً إذ العبرة في كذب البلاغ أو صحته هي بحقيقة الواقع ، وإذ كان الحكم المطعون فيه جاء مفتقراً إلي بيان ذلك ، فضلاً عن انه لم يبين نص القانون الذي أنزل بمواجه العقاب على الطاعن ، فانه يكون مشوباً بعيب القصور بما يبطله

The U.A.E operates under a civil law system, and statutes are the primary source of law. Alternative of Dispute Resolution

There are No Laws or rules governing Mediation in the U.A.E and Mediation is usually a strictly private Business regulated by agreement between the Parties. The DIFC ( Dubai International Financial Court) has promulgated mediation Rules, which may be resorted to by parties wishing to settle their dispute such means instead of litigation in courts. The contracting parties are Free to agree on the procedure of Mediation and also to appoint a Mediator.

Real Estate Regulatory Agency

RERA is The regulatory arm of Dubai Land Department, provides support to the department through regulate the relationship between companies managing properties and residential buildings, as well as regulating the work of real estate brokers and owners associations. The department sets legislation to regulate the relationship between all contracting parties and to organizes the exchange process of properties.

اشكال اوامر الضبط

ألاولـــى :- هى اوامر الضبط الخاص بموضوع معين:اى التى يقصد بها تنظيم نشاط معين عن طريق تشريعات خاصة مثل تنظيم المرور وتنظيم اقامه البناء ….. الخالثانية :- وهى اوامر الضبط الخاص بالهدف او باغراض اخرىمثل تنظيم الحدائق والطرق والاماكن الاثرية والثالثة :- وهى الخاصه بالاشخاص اى التى تستهدف مخاطبة الاشخاص لتنظيم مهنة او عمل معين مثل الاطباء ، المحامين ، المدرسين …….الخويتضح لنا مما سبق ان الذى يعنينا هنا هى اوامر الضبط الادارى الفردى وهى التى يقصد بها القرار الادارى الذى تصدرة الادارة بقصد تطبيقة على فرد معين او على عدد من الافراد المعينين بالذات . ولقد اشترط الفقة عدة شروط يجب توافرها فى الاوامر الفردية حتى تصبح مشروعة.

لجوانب القانونية للأعمال المصرفية

تؤدى البنوك دورا كبيرا وهاما فى مجال النشاط المالى والاقتصادى والتجارى فى كافه دول العالم وبخاصة فى مجال التجارة الداخلية والخارجية ، فضلا عن انها تحتل أهمية كبرى بالنسبة لما استحدثته وتستحدثة من خدمات فى شتى المجالات بمرونة ومواكبة للأحداث الداخلية والخارجية التى تتطور يوما بعد يوم.
وتقوم البنوك بوظائفها المالية والاقتصادية والتجارية فى جميع الدول بغض النظر عن حجمها او النظام السياسى الذى تنتهجة ، فدور البنوك يؤثر بفاعلية على اقتصاد البلاد سواء كان نظامها رأسماليا او اشتراكيا ، ويقوم النك فى سبيل أداء وظيفته بالعديد من الاعمال التى يمكن تأصيلها الى نوعين متميزين الأول وهى تجميع المدخرات اما الثانى فهى استثمار ما يتجمع لدى البنك من اموال .
وتعد البنوك التجارية والتى تقوم بصفة معتاده بقبول ودائع تدفع عند الطلب او الآجل المحدد ، وتزاول عمليات التمويل الخارجى والداخلى ، وخدمتة كل ما يحقق اهداف خطة التنمية وسياسة الدولة ودعم اقتصادها ، وكذلك تباشر عمليات تنمية الادخار والاستثمار المالى فى الداخل والخارج بما فى ذلك القيام بالمساهمة فى انشاء المشروعات .
ولما كانا قد ارجعنا جميع العمليات المصرفية وتاصيلها الى تجميع المدخرات واستثمار ما يتجمع لدى البنك من اموال ، فان هذا التأصيل يستبين منة ان عملية تجميع المدخرات بصورتيها الشائعة الودائع عند الطلب او ما يعرف بالحساب الجارى والودائع لآجال محدده بما فيها كافة صور الاوعية الادخارية وهى حجز الزاوية المعول عليها والاساس الذى تقوم علية كافة الاعمال المصرفية الاخرى والتى يمكن ان نطلق عليها الوظائف الاخرى للبنوك او التوظيفات الاخرى . كل هذة الصور تنتمى فى اصولها الى العقد بأركانه وشروطه الوارده فى القانون المدنى ويجب ان تتوافر فى هذه العقود كافه الشروط الموضوعية لصحة العقد وهى الاهلية (الرضا) والمحل والسبب .
واذا كانت الوديعة تتخذ صور واشكالا ومسميات متعدده الا ان الصورة الغالبة من الناحية العملية والتى تتطلب شيى من التفصيل فهى الودائع عند الطلب او الحساب الجارى .
فالحساب الجارى عقد شانه شأن اى عقد يرتب التزامات متقابلة بين البنك والعميل طالب فتح الحساب ، ولقد جرى العرف المصرفى على ان يتم فتح الحساب الجارى بموجب طلب او نموذج يقدمة البنك للعميل لاستيفاء بياناته والتوقيع علية ، وبمجرد استيفاء هذا الطلب وتقديمة من العميل الى البنك يعتبر عملا ايجابيا من العميل يقابلة قبولا من البنك سواء كان القبول صريحا او ضمنينا ثم يلى ذلك استيفاء العميل لنموذج التوقيع هو اساس التعامل على الحساب اذ يجب ان يمهر به كافة الشيكات التى يسحبها على حسابة للغير .ن كما ان طلب فتح الحساب الذى يوقعة العميل يتضمن كافة الشروط التى يتطلبها البنك للتعامل على الحساب ، وعادة ما يضمنة النك كافة الضمانات والاحتياطات الكفيلة بمنع اساءة استعمال الحساب . ومتى فتح الحساب بالشروط والضوابط التى قبلها العميل وارتضاها البنك اصبح للعميل حساب بالبنك له ان يتعامل علية ايداعا وسحبا ، كما يجوز للعميل ان يوكل غيرة فى التعامل على الحساب وذلك وفقا للضمانات والشروط القانونية المتطلبة فى الوكالة والمعمول بها فى الدولة ، كما انه من المهم الاشارة الية الى ان مطابقة توقيع العميل او الوكيل على الشيك المقدم للصرف من اهم الضمانات التى تطمئن البنك الى صحة صدورة من العميل او وكيلة ، وبطبيعة الحال لا يفترض فى موظف البنك الذى يناط بة مطابقة التوقيع ان يكون خبيرا بدرجه تعادل ما تتوافر فى خبراء مصلحة ابحاث التزييف والتزوير ولذلك فان كل ما يطلب من الموظف هو التأكد من مطابقة التوقيع للمظهر الخارجى للتوقيع المحفوظ لدية بالبنك .
الا ان ما يمكن ان يثار هنا هو مدى التزام البنك فى حالة صرفة لشيك ثبت فيما بعد ان التوقيع به مزورا ؟ المتبع فى مثل هذة الحالات وما اميل الية هو الزام البنك بقيمة الشيك المزور استنادا الى ما يعد من مخاطر المهنة التى يتحملها البنك ولا يسأل البنك فى هذة الحاله اى اى تعويضات ىخرى طالما انة لم ينسب الى البنك اى خطأ ، اما اذا كان البنك قد اسهم وساهم بفعلتة فى تحقق وتسهيل هذا التزوير فيسأل عن ذلك وفقا لقواعد المسئولية دون اخلال بالجزاء الجنائى قبل المتسبب ان استوفت اركان الجريمة .
ويعد فتح الحساب لدى البنك حقا اجازتة القوانين والاعراف المصرفية لجميع الاشخاص الطبيعية كامل الاهلية وكذلك من لم يبلغ السادسة عشر من العمر اذا اذنت المحكمة له بادارة امواله وكذلك من بلغ الثامنة عشر واذنت لة المحكمة فى ادارة تجارتة .
كما يجوز للاشخاص الاعتبارية ايضا فتح حساب سواء كانت شركات بانواعها او جمعيات اهلية شريطة استيفاء الشروط التى تضمنتها لوائح تأسيسها وكذلك الشروط التى اوجبتها القوانين داخل الدولة بالاضافة الى ما يشترطة البنك من قواعد . وتعدد صور استعمال الحساب الجارى الا ان الصورة الغالبة هى سحب شيكات على الحساب سواء لصالح صاحب الحساب او للغير كما ان التعامل على الحساب يتخذ احدى الصورتين اما ان يتم نقل مبلغ من الحساب الى حساب شخص اخر سواء بذات الفرع او باى فرع آخر من فروع ذات البنك ، او يتم بنقل مبلغ من الحساب لحساب نفس العميل ببنك آخر او ما اصطلح على تسميتة بالنقل المصرفى او التحويل المصرفى . ، ويراعى ان نقل مبلغ من الحساب الى حساب آخر ايا كان يعتبر عقدا يسمى عقد النقل المصرفى تنطبق علية كافة الشروط العامة للعقود الا ان هذا العقد لا تنصرف شروطة الا الى طرفية البنك والعميل ولا يجوز للغير ان يتمسك بما جاء به من شروط وبالتالى فلا يجوز فلا يجوز للمحال الية مبلغ من الحساب ان يتمسك بعقد النقل المصرفى ويطالب بتنفيذه اذا ما تراخى البنك فى ذلك ولكن يكون للعميل ان يطالب بذلك وله ان يطالب البنك بالتعويض اذا ما ثبت ان عدم التزام البنك بما جاء بعقد النقل قد سبب له ضررا
