5) Do not keep silent when you witness a drug crime, as you are legally under the obligation to inform the concerned authorities (police hotline).

جريمة الزنا

تعبر الجريمة من الوجهة الاجتماعية عن كل سلوك جدير بالعقاب ، سواء عاقب المشرع الوضعى عليه أم لم يعاقب . ويعنى ذلك أن الجدارة بالعقاب هى ضابط الجريمة . وتحديد هذه الجدارة رهن بالرأى العام السائد فة مجتمع معين من حيث تقديره أن بعض الافعال تمس مصالح اساسية تهمه حمايتها . 

وعلى ذلك فالجريمة فى هذا المعنى تختلف من مجتمع الى آخر ، وتختلف بإختلاف العصور والأماكن .

ولما كانت الجريمة تقوم على اركان ثلاثة اولها الركن الشرعى او الكنسي وهو الصفه غير المشروعة للفعل ويكتسبها اذا توافر له امران الاول هو خضوعه لنص تجريم يقرر فيه القانون عقابا لمن يرتكبه ، وثانيها عدم خضوعه لسبب من اسباب الاباحه لان انتفاء اسباب الاباحه شرط ليظل الفعل محتفظا بالصفة غير المشروعية التى اكسبها له نص التجريم .

اما الركن الثانى ويتمثل فى المظهر الذى تبرز به الجريمة الى العالم الخارجى . ويقوم هذا الركن على عناصر ثلاثه العنصر الاول هو الفعل وهو النشاط الايجابى او الموقف السلبى الذى ينسب الى الجانى اما العنصر الثانى فهو النتيجه وهى اثره الخارجى الذى يتمثل فيه الاعتداء على حق يحميه القانون . اما العنصر الثالث فهو علاقة السببية وهى الرابطة التى تصل ما بين الفعل والنتيجه ، وثبت ان حدوث النتيجه يرجع الى ارتكاب الفعل . 

اما الركن المعنوى فهو الارادة التى يقترن بها الفعل سواء اتخذ صورة القصد الجنائى حين توصف الجريمة بأنها عمدية ، او اتخذت صورة الخطأ غير العمدى وعندئذ توصف بأنها غير عمدية ، بالاضافة الى الاركان الخاصة التى يجب ان تتوافر لكل جريمة فان انتفى احداهما فلا جريمه على الاطلاق .

وتعد العلاقات الجنسية على مر التاريخ ظاهرة انسانية قد اصابها من التغير والتبديل أكثر مما اصاب اية ظاهرة أخرى . وذلك لخضوعها للعديد من العوامل المعقده والمتشابكة كالعامل الاقتصادى ، والعامل البيولوجى ،والعامل الاخلاقى .

المنع من السفر

تعد الحرية الشخصية من الحقوق الطبيعية التي نشأت بنشوء الإنسان والتصقت بحياته وفكره قبل أن توجد المجتمعات وتقوم الدولة فهي إذن حق طبيعي لا يجوز المساس به أو إلغاءه ، ولا يجوز التنازل عنه ، ولا يزول الا بزوال الإنسان ذاته ن وسلطة الدولة إزاء هذه الحرية ليست سلطة تقرير أو إعطاء وإنما هي سلطة إعلان وتنظيم وحماية . 

الا ان كفالة هذه الحرية لا يعنى إطلاقا مساس ذلك بالنظام العام مساسا مباشرا فليس هناك ما يمنع المشرع من وضع قوانين لتنظيم ممارستها بما يكفل مصلحة الجماعة وتحقيق الأغراض السامية التي قدرها عند سن هذه القوانين والتي جعلها المشرع سياجا لتلك الحرية الشخصية . 

وتعتبر حماية الحقوق وحريات الأفراد أولى الواجبات التي تقع على عاتق الدولة القانونية وتمثل قواعد القانون الجنائي الموضوعي والاجرائى اخطر ما يمكن ان تمارسه الدولة باسم المجتمع لتحقيق مصلحة الفرد ونفع الجماعة وذلك لمساسها بالحقوق الأساسية للفرد والتي من أهمها حقه فى الحرية .

وعلى الرغم من ان التنظيم القانوني أمر هام لاستخدام الحرية، الا ان هذا التنظيم قد يتوغل بشكل ما – سواء من حيث نصوصه او تطبيقه – الى الحد الذي يجعله عائقا بين الشخص وبين الممارسة المشروعة لحريته الشخصية . وعلى ذلك فمن الأمور المرفوضة ان يصبح القانون أداة للاضطهاد او لتجاهل هذه الحقوق والحريات ، وتمثل قواعد القانون الجنائي هنا أداة الدولة فى ممارسة هذا التنظيم بشرط ان يكون محكوما بقاعدة الشرعية التي تحكم التشريع الجنائي فى القانون المعاصر .

وإذا كانت الشرعية الجنائية فى وجهها الموضوعي او بعبارة اخرى 0 مبدأ لا جريمة ولا عقوبة الا بنص - تمثل حجر الأساس لقانون العقوبات بقسميه العام والخاص ، فان الشرعية الجنائية فى وجهها الاجرائى او بعبارة اخرى مبدأ قرينة البراءة او ان الأصل فى الإنسان البراءة تمثل حجر الأساس لقانون الإجراءات الجنائية التي تهدف أساسا الى حماية الحرية الشخصية للإنسان والتي تعتبر أول حق من حقوقه كانسان بعد حقه فى الحياه.

ولضمان شرعية القيود والضوابط التى قد ترد على الحرية الشخصية اجمع الفقه على ضرورة توافر عناصر ثلاثة للشرعية الجنائية الإجرائية وهى تقوم بهذا التنظيم 

العنصر الأول :- يكمن فى وجوب ان يكون التشريع هو المصدر الوحيد لقواعد وأحكام الإجراءات الجنائية .

العنصر الثانى :- ان يتقيد المشرع المبادىء التي يضعها الدستور 

العنصر الثالث :- الإشراف والرقابة من السلطة القضائية على التنفيذ العملي لقواعد الإجراءات الجنائية . 

ومما لاشك فية ان الأوامر التي تصدر بمنع الأفراد من السفر تمثل قيدا على حرية الإقامة والتنقل التي هي من أعمده الحرية الشخصية التي كفلتها الدساتير فى مختلف دول العالم . 

ولما كان ذلك فان حق إصدار أوامر المنع من السفر هو حق مقصور على القاضي المختص والنيابة العامة لضرورة تستدعيها التحقيقات وصيانة امن المجتمع . بيد أنة ولا عتبارات تمس المصلحة العامة أعطت بعض الدول هذا الحق لبعض الجهات الرقابية الأخرى ارتأت أنها قادرة بحكم أهميته دورها فى إصدار قرارات المنع من السفر لمقتضيات المصلحة العامة وامن المجتمع ، مع إعطاء السلطات القضائية المعنية فى الدولة فى حق الرقابة على هذه القرارات ومراقبة صحتها .

فإذا كانت النيابة العامة هي سلطة التحقيق القضائية فى البلاد وهى التي تمثل الهيئة الاجتماعية فى هذا الشأن الى جانب سلطتها فى توجيه الاتهام وتحريك الدعوة الجنائية ويقف على قمة رأسها النائب العام ، فان للنائب العام سلطة استثنائية ميزة القانون فى ان يصدر أمرا بمنع المتهم فى جرائم معينة وهذا الأمر يستند الى اعتباره إجراءا تحفظيا طالما انه رأى ان مقتضيات التحقيق وضرورة العدالة تقتضى منع المتهم من السفر ، الا ان هذا الحق ليس مطلقا بل مقيد بضرورة توافر شرطين 

الشرط الأول :- ان يكون هناك تحقيقا يستلزم هذا الاجراء 

الشرط الثانى :- ان يكون التحقيق فى أحدى الجرائم المنصوص عليها فى القانون وهى جرائم اختلاس المال العام والعدوان علية والتربح وكذلك الجرائم التي تقع على الهيئات والمؤسسات التابعة للدولة والخاضعة للاشرافها 

وفى كل الأحوال يجوز للمتهم ان يتظلم من هذا الأمر أمام قاضى الأمور المستعجلة بطلب على عريضة بواسطة الشخص نفسه او بوكيله او أمام المحكمة المختصة بنظر الدعوى اذا أحيلت الدعوى .

اما اذا كان الأمر الصادر بالمنع صادرا من جهات تنفيذية بناء على طلب من رئيس الدولة او رئيس الوزراء فهو يعد بمثابة قرار أدارى ، إذ أنة يجوز بقرار من وزير الداخلية لأسباب هامة يقدرها رفض منح جواز سفر او تجديد ه او سحب جواز السفر او منع من السفر ، إذ ان ذلك بمثابة سلطة تقديرية خولها القانون لبعض الجهات الرقابية ذلك حال وجود أسباب لها ما تبررها الا انه فى هذه الحالة فان القرار يجوز التظلم منة بوصفة قرارا إداريا طالما شابة عيب من العيوب التي تعترى القرار الا دارى كعدم الاختصاص او الشكل او السبب او الغاية او مخالفة القانون او إساءة استعمال السلطة .

It is required to note that the penalties for breaching any of the following drug laws might include imprisonment and definitely deportation.
1) The consumption of illegal drugs in the UAE is a Crime, whoever commits will be punished by possible imprisonment and/or deportation. Drugs that are legal in your home country may not necessarily be legal in the UAE, this could include drugs that you have been prescribed for medical reasons in your home country.
2) The import of illegal drugs in to the UAE is a criminal offence.. This includes whilst transiting through Dubai airport. If you have obtained a prescription for medication from your home country, it is recommended to carry a translated and attested copy of the prescription with you.
3) Take particular care when returning from holiday if you may have come in to contact with anyone who has taken an illegal drug and may have passed even the smallest quantity on to you. Possession of illegal drugs, even for example a speck on a shoe, may be a criminal offence.
4) Some medications are illegal in the UAE if possessed without a prescription from a Doctor. These include some sleeping pills, antidepressants and pain killers. Check with your Doctor whether a prescription is required before taking these types of medicines.
5) Do not keep silent when you witness a drug crime, as you are legally under the obligation to inform the concerned authorities (police hotline).
6 ) Convince a drug consumer to surrender himself to the concerned authorities prior to being caught, as the applicable law considers the same and takes it into consideration.

U.A.E Civil Law System Prevailing Disputes: The U.A.E drives under a civil law system, and statutes are the prime source of law. There is no Principle of binding Precedent, and judgments of the higher courts are not binding on the lower courts (although they can be useful guide as to how a court my react in cases with similar subjects in dispute). Each Case is decided on its own merits and facts. Moderately recent federal legislature requires commercial disputes to first be referred to a understanding committee agreed by the U.A.E Ministry of Justice. The Reconciliation committee attempts to facilitate a settlement, failing which the parties may proceed with filing a lawsuit at the competent courts of law. This technique is not appropriate in the Emirate of Dubai and Ras Al Khaimah.

Interesting Court of Cassation | Dubai, United Arab Emirates | 04-3522144

In a new Dubai Court Judgment, the Court ruled in the application filed by the Attorney General that, in the event of a right from the land developer against the buyer, the role of the Land Department is merely appeasing to propose suitable solutions for the parties in order to reach an amicable reimbursement.

If the parties equally agree to dismiss the sale agreement, only benches can issue final decisions to terminate contracts between real estate developers and purchasers.

Facts of the case

The First Respondent in this case, a real estate investment company, initiated legal action before the Dubai Court of First Instance seeking a court order against a Real Esate Agent (the “Third Respondent”) to refund the sum paid to the latter as installments of the purchase price for two real estate units located in the Water Front living project. The legal action was filed on the ground that the Third Respondent failed to register the unit as required by the law.

The Third Respondent pleaded that in this transaction, it was acting as an agent for the Second Respondent and requested the action to be dismissed for having been brought against a party who has no capacity within the substantive matter of the dispute and therefore sought to join the Second Respondent to the case.

Procedural History

The First Respondent (Claimant) filed its amended statement of claim to include the name of the Second Respondent. The Land Department confirmed that the units (the subject of the dispute) are registered in the Interim Real Estate Register. In light of this, the First Respondent sought to annul the Sale agreement or alternatively to cancel/terminate the agreement as the Second Respondent failed to commence any construction on the units to date, nor did it secure the required building permits which the First Respondent sought to establish by way of first hand inspection by a court appointed expert.

The Court of First Instance rendered its ruling by dismissing the case. As a consequence, the First Respondent appealed before the Court of Appeal which overturned the lower court’s decision and further rejected the case as a result of the administrative decision (issued in the same case) by the Dubai Land Department.

The First Respondent challenged the Court of Appeal’s decision before the Dubai Court of Cassation which dismissed the case on the ground that the action is time barred.

The Attorney General challenged the same Court of Appeal ruling pursuant to Article 174 of the UAE Civil Procedure Law which entitled the Attorney General to challenge final decisions of any court provided that the court’s judgment contradicts the law or its application.

The Court of Cassation

The Attorney General argued that the appealed judgment was wrong to consider the administrative decision (rendered by the Land Department) as a conclusive and binding judicial ruling which had the effect of res judicata, in other words, the lower court rendered the Land Department’s decision as equivalent to a Court judgment, which was incorrect. The Attorney General further pleaded that the appealed decision contradicted both Article 11 of the Interim Real Estate Register Law No. 13 of 2008 and Article 15 of the Executive Council Decision no. 6.

The Cassation Court, in its ruling, stated that articles from the UAE Civil Transactions Law as well as the aforementioned articles the Interim Real Estate Register Law No. 13 of 2008 and the Executive Council Decision No. 6 of 2010 provide that contracts may be terminated either by parties’ agreement or a court order. Furthermore, the role of the Land Department in settling a developer-purchaser dispute is to endeavor and conciliate suitable solutions for the parties in order to reach an amicable settlement and does not extend to the termination of contracts. The court further stated that the Land Department’s decision is not conclusive so as to preclude bringing an action for breach of contract to determine entitlement to recover damages under the law.

The lower court failed to examine the merits of the dispute when it decided to dismiss the action on the basis that the Land Department had previously issued a decision authorizing termination of the units sale agreement, and that this administrative body, which was not a party to the proceedings, had exercised its powers and rights in accordance with the law. Therefore, the Cassation Court overturned the appeal judgment and referred the case back to the Court of Appeal.

Practice note:

The above Cassation decision confirms that the Land Department’s role in disputes is limited to conciliation and is subject to judicial review, it further highlighted that there is judicial control over administrative decisions and that it is the Courts that ultimately terminate real estate agreements.
